什麼是賭博

賭博是指一種利用有價值的財物（如金錢）作為賭注，投入一項結果無法事先確定、且主要靠運氣或技巧來決定輸贏的活動，目的是為了贏取更多的財物。

構成賭博的三大核心要素

根據加拿大理性博彩局（Responsible Gambling Council）與輔導機構平和坊的定義，一項活動必須具備以下三個要素才算賭博：

下注財物：投入金錢或其他具有價值的物品。

未知結果：勝負取決於隨機性或機率，無法在事前確定。

不可逆性：賭注一旦投入便無法取消、收回或更改。

常見的賭博形式賭博形式非常多樣化，主要可以分為以下幾類：

博彩遊戲：如賭場內的百家樂、老虎機、輪盤、廿一點等。

彩票與抽獎：如六合彩、刮刮樂、樂透彩。

體育及賽事投注：如賭馬、賭波（足球足球博彩）。

傳統與社交賭博：如親友間打麻雀（麻將）、玩啤牌（撲克牌）。

網絡賭博：透過線上娛樂城或投注網站進行簽賭。

法律定義與規範

在不同國家或地區，賭博的法律規範與定義有所不同：

香港：受《賭博條例》嚴格管制。除了由香港賽馬會等獲政府授權的合法渠道外，參與任何外圍、未經授權的線上或實體賭博均屬非法。

台灣：中華民國刑法設有「賭博罪」，禁止在公共場所或網路進行非法賭博活動，意圖營利提供賭博場所（抽頭）亦屬違法。

潛在的心理與社會風險

賭博會刺激大腦分泌多巴胺，帶來強烈的興奮感與快感，因此容易使人沉迷。若無法控制賭博行為，會演變成「賭博障礙」（或稱病態賭博），患者會不斷加大注碼、說謊隱瞞、並因債務問題破壞家庭與工作環境。

賭場群聚 法辦還要裁罰

高雄苓雅區前天破獲天九牌賭場，卅八人比鄰圍著方桌廝殺，不僅未保持安全距離。現場搜出百餘萬元賭資、抽頭金，因人數太多，警方動用大巴士載人，將蘇姓主嫌等三人依賭博罪移送，卅五名賭客各裁罰九千元，全部另依傳染病防治法函送衛生局裁罰，租屋函報市府斷水斷電。

Huang Nan was afraid of being investigated by the police and found Shi Ren Wan through Zeng Nan. Police Officer Huang Taiming of the Hua Branch negotiated a monthly price of 10,000 yuan in exchange for Huang Taiming’s refusal to ban it, and since January 2017, a total of 150,000 bribes have been paid to Huang Taiming. Huang Taiming denied taking bribes, arguing that it was Zeng Huangqi who used his name to bluff and deceive, but the prosecutor did not accept his defense based on relevant evidence and prosecuted him for violating the "Corruption Regulations" and other crimes. In addition, the prosecutor in charge at that time also found out that the police surnamed Zhou, who was the guard team of the Wanhua branch at the time, and the police surnamed Lin of the Xiyuan police station, entered and exited the casinos in the jurisdiction. The transfer of jurisdiction of the 2 police officers and the 5 business operators who opened a casino in Wanhua will be handled by the Beijing Municipal Inspection Bureau.

After the investigation was received by Beijian, it was discovered that two police officers went to the casino only to go to the casino to gamble. Among them, the wife of the surnamed police officer also often went in and out of the casino. No two people were found to have reported to the casino or covered the casino illegally. Therefore, it was deemed that the evidence was insufficient, and the two persons were punished not to prosecute. 萬華2警被控包庇賭場　「只有賭博」不起訴

台北市警局萬華分局前偵查小隊長黃臺明2017年涉透過友人曾煌棋收受轄區2賭場21萬元賄絡，包庇業者不被取締，去年7月被新北地檢依貪污罪起訴，當時新北檢另查出時任萬華分局警備隊周姓警員、西園所林姓警員也涉嫌包庇轄區賭場，將2人連同5名賭場負責人移轉北檢偵辦，但檢察官查出2警僅前往賭博，沒有通風報信或包庇賭場事證，今將2警不起訴，5名賭場負責人則依賭博罪起訴。

新北地檢署查出，原在萬華開設小吃店的曾煌棋，在2016年歇業後，將店面租給男子黃清源開設天九牌賭場，黃男怕被警方查緝，透過曾男找時任萬華分局警員黃臺明談妥以每月1萬元代價，換取黃臺明不舉發取締，並從2017年1月起，總計交付15萬賄款給黃臺明。另有賭場業者李啟文，也透過曾男，交付6萬元給黃臺明，讓賭場生意能不被打擾。

黃臺明否認收賄，辯稱是曾煌棋擅以他的名義在外招搖撞騙，但檢察官依相關事證不採信其辯解，依違反《貪污治罪條例》等罪起訴。另外，當時承辦檢察官還查出時任萬華分局警備隊的周姓警員，以及西園派出所的林姓警員，出入轄區的賭場，疑有包庇賭場的罪嫌，但因無管轄權，因此將2名警員以及在萬華開設賭場的5名業者，移轉管轄由北檢負責偵辦。

北檢收案後展開調查，發現2名警員到賭場只是單純前往賭博，其中周姓警員的太太，也時常進出賭場，沒有查到2人有向賭場通風報信或是包庇賭場的不法犯行，因此認為事證不足，將2人處分不起訴。至於5名賭場業者，則涉犯《刑法》賭博罪，依法起訴。
